Due Process within the context of the administrative decision-making process requires that aggrieved individuals be given the opportunity to confront the evidence against them and have their evidence considered by an impartial finder of fact in a meaningful time and manner. The Administrative Law Judges and staff in the Fair Hearings Bureau are responsible for ensuring this opportunity is afforded all parties, with or without legal representation, within state and federal requirements for all programs administered by this agency. The Bureau is responsible for scheduling hearings after a request has been made for over 17 different categories of benefits offered through these programs. After the hearings are held, written recommendations are submitted to the appropriate division director, who issues the final decision.

The Fair Hearings Bureau consists of seven Administrative Law Judges, two support staff and a Bureau Chief, who may also serve as an Administrative Law Judge. The Bureau processes over 2500 hearing requests a year. The Administrative Law Judges schedule their own hearings and write their own recommendations. The support staff performs all clerical and administrative support required for the hearing processes. They are all supervised by the Bureau Chief, who manages the Bureau and oversees its operation.
